1. Changing in regulations on prices for calculating registration fees for houses and land
From March 1, 2022, Decree 10/2022/ND-CP on registration fees takes effect, in which, regulations on the price for calculating registration fee for houses are as follows:
Registration fee calculation prices for land are land prices prescribed in
the land price tables promulgated by People’s Committees of provinces and
centrally run cities in accordance with the land law and applied at the time of
declaration for registration fee payment.
In case of land leased by the State in the form of one-off rental payment
for the entire lease term, if this land lease term is shorter than the lease term
applicable to the similar land type prescribed in land price tables promulgated
by People’s Committees of provinces and centrally run cities, the land price for
registration fee calculation in such land lease term shall be determined as
follows:
Land price of the land lease term for which the registration fee is calculated = (Land price at the Land Price List / 70 years) x Land lease term
– The price for calculating the registration fee for a house is the price promulgated by the People’s Committee of the province or city under central authority in accordance with the law on construction at the time of registration fee declaration.
– Prices for calculating registration fees for houses and land in some special cases:
+ The price for calculating the registration fee for state-owned houses sold to current tenants in accordance with the law on sale of state-owned houses, including land, is the actual selling price according to the decision of the People’s Committees of provinces and centrally run cities.
(Decree 20/2019/ND-CP does not stipulate the registration fee calculation price including attached land).
+ The price for calculating the registration fee for houses and land purchased by the auction or bidding method in accordance with the law on auctions and bidding is the actual winning auction or bidding price stated on the invoice or voucher. according to the provisions of law or the auction winning price, actual bidding according to the minutes of winning the auction or bidding or according to the written approval of auction and bidding results (if any) of the competent state agency.
(Currently, the law only regulates on pre-charged price for buyers by auction method which is the actual auction on the selling unit).
+ The registration fee calculation price for multi-storey multi-family houses and apartment buildings includes the allocated land value. The allocated land value is determined by the land price in the Land Price List issued by the People’s Committee of the province or centrally run city multiplied by the allocation coefficient. The allocation coefficient is determined according to the provisions of Decree 53/2011/ND-CP and the documents replacing, amending and supplementing (if any).
(Additional registration fee calculation price for multi-storey multi-family houses and apartment buildings, including the allocated land value)
– In case the price of house and land in the house purchase and sale contract or land use right transfer contract is higher than the price promulgated by the People’s Committee of the province or centrally run city, the price for calculating the registration fee for the house or land is the price of the house or land in land use right transfer contracts, house purchase and sale contracts.
2. Guide users to reflect spam messages, spam calls
The Minister of Information and Communications promulgates Circular 22/2021/TT-BTTTT guiding Decree 91/2020/ND-CP on combating spam messages, spam emails and spam calls.
Accordingly, instructions for users to reflect and provide evidence of spam messages, spam calls and spam emails are as follows:
* For spam messages:
– Reflect via text message to switchboard 5656 with the following syntax: S [Distribution source][Spam message content] or S (distribution source)(Spam message content) to 5656.
– Reflect according to instructions at website thongbaorac.ais.gov.vn or via call center or application.
* For spam calls:
– Reflect via text message to the 5656 switchboard: The user composes a reflection message according to the syntax: V [Spamming source][Spam call content] or V (Spamming source)(Spam call content) send 5656.
– Reflect according to instructions at website thongbaorac.ais.gov.vn or via call center or application.
* For spam email:
– Reflect through forwarding spam emails to the email address: chongthurac@vneert.vn;
– Reflect according to instructions at website thongbaorac.ais.gov.vn or via call center or application.
Circular 22/2021/TT-BTTTT takes effect from March 1, 2022.
3. Trading in network security products and services is a conditional business line of business
This is the content of the Law amending the Law on Public Investment, the Law on Investment in the form of public-private partnership, the Law on Investment, the Law on Housing, the Law on Bidding, the Law on Electricity, the Law on Enterprises, the Law on Special Consumption Tax, Law on Civil Judgment Execution 2022.
Accordingly, in Clause 5, Article 3 of Law No. 03/2022/QH15, supplementing the business lines of network security products and services (excluding business of network information security products and services and trading of civil cryptographic products and services) is a conditional business and investment industry.
In addition, Law No. 03/2022/QH15 also amends provisions in a number of other Laws, for example:
– Amending regulations on rights and obligations of company members (Articles 49, 50) of the Law on Enterprises;
– Amending and supplementing Point g, Clause 4, Section I of the Special Consumption Tariff in Article 7 of the Law on Special Consumption Tax;
– Amending and supplementing Clause 1, Article 23 of the Law on Housing;
