On recently days, Vietnam has continued recording COVID-19 positive cases. Many people are pressing with acts like declaring, reporting untrue medical information which affecting the anti-epidemic. In the fact of rapidly and widely spreading of epidemic, it is extremely necessary to strictly handle those who have untrue medical reports.
Pursuant to Article 8 of Law on Prevent and Control infectious diseases 2008, some of prohibited acts are:
“3. Concealing and failing to report or reporting not in a timejy manner cases of contracting infectious diseases in accordance with law.
4. Intentionally declaring or reporting untrue information on infectious diseases.”
However, this Law doesn’t have sanctions for violators. With acts like declaring, reporting untrue medical information, authorities can be based on Decree No.176/2013/ND-CP to sanction but the curent level of sanction from 05-10 million dongs is too low, not enough to deter another person.
Article 240 of the Criminal Code 2015 pescribes crime Spreading dangerous infectious diseases in human as:
“1. A person who commits any of the following acts that spread dangerous infectious diseases in human shall be liable to a fine of from VND 50,000,000 to VND 200,000,000 or face a penalty of 01 – 05 years’ imprisonment:
a) Bringing or allowing another entity to bring animals, plants or products thereof or other items that are likely to transmit dangerous infectious diseases in human out of the epidemic zone, unless otherwise prescribed by law;
b) Bringing or allowing another entity to bring animals, plants or products thereof or other products that are infected or carry dangerous pathogens that are likely to be transmitted to human into Vietnam’s territory;
c) Other acts that spread dangerous infections in human.
The law doesn’t regulate on “Other acts that spread dangerous infections in human” but those have had deceitful behavior, known that they are infected but deliberately declared dishonestly can be as this crime above.
Consequently, depending to the nature and level of violation, violator can sufferadministrative sanctions or criminal handling.
