More and more domestic goods are exported to foreign market, including Vietnamese cosmetic products. However, many cosmetic enterprises are facing difficulties in carrying out procedure for granting Certificate of free sale (CFS). T2H Lawyers would like to help your enterprise have an overview of this procedure.
Step 1: Prepare the dossier.
- A written request for granting CFS (in form) in both Vietnamese and English.
- A copy of cosmetic product proclamation report having the number of dossier receipt issued by competent agency and stamped by trader requesting for granting CFS.
- Trader dossier (if it is the first time to request for granting CFS in location which CFS is being issued) includes:
+ A written register for signature of the person who is authorized to sign the application for granting CFS and the trader’s seal;
+ A notarized of Certificate of business registration;
+ List of manufacturers (if any), including names and addresses of each manufactures, products manufactured for export.
Step 2: Submit the dossier.
Submitting dossier for granting certificate of free sale (CFS) at the agency issuing CFS of the Health Service of the provinces and centrally cities where the cosmetic manufacturer is located.
Step 3: Examine the dossier and grant the CFS.
- The dossier receiving officer exams and issues a receipt to the CFS applicant about the receipt if the dossier is valid or return the dossier and request for supplementing documents if the dossier is invalid.
- CFS is granted within 05 working days from the receipt of valid dossier.
- If the dossier is invalid, competent agency shall send an announcement to the CFS applicant about the refusal of granting a CFS.
Timeline: Certificate of free sale (CFS) is effective for 2 years from the date of issue.
*NOTES:
– Agency issuing CFS could carry out an examination at the manufacture if the examination on the dossier is not sufficient to issue a CFS or detecting any signs of violation of the regulations for the previous CFS.
– The number of CFS is granted at the request of the trader.
