Re-granting Certificate of land use rights and ownership of houses and other land attached assets.

Households and individuals, communities that lose Certificate of land use rights and ownership of houses and other landattached assets (below referred to as the certificate) or supplementary pages of these certificate but wondering about the procedure of re-granting the Certificate or supplementary page of these certificate. I.The order of execution:

1.Households and individuals, communities shall declare to the communelevel People’s Committee of the locality where the land is located the loss of their certificates or supplementary page of  these certificate. The commune-level People’s Committee shall post up the loss at these certificate office, except the loss due to a natural disaster or fire.

2.After 30 days from the date of posting up the loss of the certificate or supplementary page of  these certificate at the office of the commune-level People’s Committee, for households, individuals or communities, the person whose certificate or supplementary page is lost shall submit a dossier of request for re-grant of the certificate.

3.The land registration office is responsibility to check the dossier; the extract of the cadastral map or the extract of the cadastral survey of the land parcel, in case the cadastral map is unavailable and a cadastral survey of the land parcel has not yet been conducted; make a dossier and submit it to a competent state for signing a decision to cancel the lost certificate or supplementary page, and sign, re-grant the certificate of land use rights and ownership of houses and other land-attached assets; and adjust and update the change in the cadastral records and land database; hand over the certificate or supplementary page to the land user concerned or send it to the commune-level People’s Committees for handover, in case of submission of dossiers at commune level.

B.Components of the dossier:

1.Applications for re-grating Certificates or the supplementary page;

2.Certificate of commune-level People’s Committee on posting notice of loss of certificate or supplementary page within 15 days;

3.Certificate of commune-level People’s Committee about a natural disaster or fire in case losing certificate or supplementary page due to a natural disaster or fire.

C.The implementing agencies:

The land registration office of district.

D.The time limit:

The People’s Committee of the province regulates about the time limit but not more than 10 days from the receipt of valid dossier.

The time limit excludes weekends and public holidays prescribed by law, time for receipt of dossiers at the commune-level authorities, time for fulfillment of financial obligations of land users, time for consideration and handling of cases of unlawful land use and solicitation of expert opinions.

For communes in mountainous, island, deep-lying and remote areas and areas with difficult socio-economic conditions or extremely difficult socio-economic conditions, the time limit shall be extended by 10 days.

Results of settlement of administrative procedures shall be notified to land users and owners of land-attached assets within 3 working days after those results are available.
