Foreign individuals and organizations want to register a trademark in Vietnam have to apply a file of registration of protection directly to the Intellectual Property Office of Vietnam as provision or apply it via Madrid System designated to Vietnam.
Filing applications of registraion of the foreign mark directly to Intellectual Property Office of Vietnam
- According to Clause 1, Article 89 of the Intellectual Property Law, the following individuals and organisations are eligible to apply directly at Intellectual Property Office of Vietnam.
+ Foreign individuals permanently residing in Vietnam;
+ Foreign organizations and individuals having production or business establishments in Vietnam.
- According to Clause 2 of this Article, foreign individuals not permanently residing in Vietnam, foreign organizations and individuals without production or business establishments in Vietnam shall file applications for registration of the trademark through their lawful representatices in Vietnam.
Filing applications of registraion of the foreign mark via Madrid System designated to Vietnam.
- Conditions applicable to this form include:
+ Individuals of nationality in the country which is a member of the Madrid System or organizations having legal business establishments in the country which is a member of the Madrid System have the right to apply for international trademark registration under Madrid System.
+ The international trademark registration application under the Madrid System must be based on the basic registration application that has been filed or has been granted the registered mark certificate in the host country.
